GENERAL TERMS AND CONDITIONS OF SALE, DELIVERY AND PAYMENT

ARTICLE 1: APPLICABILITY
a. These conditions apply to all offers, sales and deliveries by the private limited company called YTS Pump Engineering BV
b. These conditions apply both within and outside the Netherlands, regardless of the place of residence or establishment of the parties involved in any agreement.
c. If the other party uses other general terms and conditions, such as purchasing conditions, these are not binding for YTS Pump Engineering BV, not applicable and are hereby expressly rejected by YTS Pump Engineering BV. By means of the applicability and non-voidability of these general terms and conditions, the other party expressly waives its general terms and conditions, such as purchasing conditions.
ARTICLE 2: OFFERS
a. All offers and price quotations are entirely without obligation, unless expressly stated otherwise. They have been made to the best of YTS Pump Engineering BV's knowledge and are based on any information provided upon request.
b. The information provided by YTS Pump Engineering BV in images, websites, catalogues, folders, drawings or in any other way regarding size, capacity, performance, color, material structure, finish or results must be considered to have been provided as an approximation and without obligation. YTS Pump Engineering BV is not bound by this information and therefore accepts no liability for any inaccuracies in this information.
c. Our offers are valid for 30 days from the quotation date.
ARTICLE 3: ORDERS/AGREEMENTS
a. An order is understood to mean: any agreement with YTS Pump Engineering BV, regardless of whether it undertakes to supply goods or carry out work.
b. Complaints can be made within 8 days after YTS Engineering BV has been sending an order confirmation, which means that the purchasing party has accepted the goods as described in the confirmation.
c. If a local law is at stake, this must first be reported by the purchasing party, YTS Pump Engineering BV will respect this.
ARTICLE 4: LIABILITY
a. YTS Pump Engineering BV is, except for the provisions in article 7 of these conditions, not liable for any damage that is either directly and/or indirectly the result of the delivered goods, including additional work, not complying with the agreement, unless this is due to its intent or gross negligence. Therefore, YTS Pump Engineering BV does not accept this in the event of force majeure.
b. YTS Pump Engineering BV accepts no liability for any damage resulting from the use of its website and/or the use of the information and/or functionalities stated/placed thereon.
c. If YTS Pump Engineering BV is liable for damages for any other reason in connection with the agreement, the compensation owed by it will always be limited to a maximum of the invoice amount (excluding VAT) in connection with the goods and/or services in question, with a maximum of EURO 200.00 (two hundred euros).
d. The buyer will never be the owner of unpaid goods received, delivered by YTS Pump Engineering BV.
ARTICLE 5: DELIVERY TIME AND PLACE OF DELIVERY
a. Deliveries will be sent to the specified location. See also ‘delivery’.
b. Exceeding delivery times, for whatever reason, never gives the buying party any right to compensation, termination of the agreement or non-fulfilment of any obligation that may arise for him from the relevant agreement or from any other agreement, whether or not related to this agreement. The expected delivery time can be determined from the order confirmation and this can be responded to.
c. In the event of non-compliance with payment, Dutch law will apply.
ARTICLE 6: PAYMENT CONDITIONS
a. Unless expressly agreed otherwise (in writing), payment of invoices sent by YTS Pump Engineering BV must be made within 30 (thirty) days after the invoice date, without deduction of discounts and without any form of compensation.
b. In the case of internet transactions via a website, such as for web shop/web shop activities, payment is made in advance using a payment method indicated on the site, or in another expressly agreed upon method in writing.
c. All payments must be made, without deduction or debt settlement, at the office of YTS Pump Engineering BV or to a bank or giro account to be designated by YTS Pump Engineering BV.
ARTICLE 7: COMPLAINTS
a. Any complaints, both regarding the delivery of goods, services provided and invoice amounts, must be submitted to YTS Pump Engineering BV in writing and by registered mail within 14 (fourteen) days after receipt, accurately stating the facts to which the complaints relate. The right of the other party to complain lapses with regard to goods processed by or on behalf of the other party. Compensation for damaged packaging must be recovered from the carrier.
b. YTS Pump Engineering BV is only obliged to take note of submitted complaints if the other party concerned has fully complied with all its existing obligations towards YTS Pump Engineering BV at the time of submitting its complaints, arising from whatever agreement and from whatever it consists of.
ARTICLE 8: COMPENSATION FOR LATE OR NON-PAYMENT
If payment of the invoices sent by YTS Pump Engineering BV has not taken place within 30 (thirty) days after the invoice date, YTS Pump Engineering BV may charge judicial interest. This will be 1% per month. In the event of late payment, all collection costs will be for the buyer.
ARTICLE 9: SHIPMENTS ON CONSIDERATION
In consultation, there are options to have goods available for any exhibitions.
